Item 3. Legal Proceedings

 

Litigation arises from time to time in the ordinary course of Swift’s business. Since early 1997, a case has been pending between Swift and the Lower Colorado River Authority in the 155th Judicial District Court of Fayette County, Texas, over the interpretation of a farmout agreement covering land in that county and the entitlement of the parties to the farmout to production revenues from wells on those lands. This case was settled in the latter half of 1999, partially through the negotiated purchase by Swift of certain interests of the Lower Colorado River Authority in these properties.
